Terms of Service

These Terms of Service ("Terms") govern your access to and use of Resorteer, the hospitality job platform operated by Elementra LLC ("Elementra," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service.

Resorteer connects hospitality employers with job seekers. Employers may post job opportunities and manage hiring activity. Candidates may browse jobs, create profiles, apply for roles, and receive job alerts. We may modify, suspend, or discontinue any part of the Service at any time.

You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company or property, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as needed.

We may suspend or terminate accounts that violate these Terms, create security risks, or are inactive for an extended period, subject to applicable law.

When you create a candidate profile or apply for a job, you authorize us to share your submitted information with the relevant employer. You represent that your application materials are truthful and that you have the right to share them.

We do not guarantee employment, interviews, or responses from employers.

Employers are responsible for the accuracy of job postings, compliance with employment and anti-discrimination laws, and lawful handling of candidate information received through the Service.

You may not post misleading, fraudulent, unlawful, or discriminatory job listings, or use candidate data for purposes unrelated to evaluating or hiring for a posted role without appropriate consent.

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Scrape, crawl, or harvest data from the Service without our permission
• Attempt to gain unauthorized access to accounts, systems, or data
• Upload malware, spam, or content that infringes third-party rights
• Interfere with the operation or security of the Service
• Misrepresent your identity, affiliation, or authorization

The Service, including its design, branding, software, and original content, is owned by Elementra or its licensors and protected by intellectual property laws. You retain ownership of content you submit, but grant us a worldwide, non-exclusive license to host, display, reproduce, and distribute that content as needed to operate and promote the Service.

"Resorteer" and related marks are used in connection with the Service. You may not use our branding without prior written permission.

The Service may integrate with third-party services such as authentication providers, email delivery, or storage platforms. Your use of those services may be subject to separate terms and privacy policies. We are not responsible for third-party services we do not control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that job listings or candidate profiles are accurate or complete.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEMENTRA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

You agree to defend, indemnify, and hold harmless Elementra LLC and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of another person or entity.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe termination is necessary to protect the Service, users, or third parties.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
